Crime జరగడానికి ముందే కొనుగోలు చేసిన Propertyని ఆ తర్వాత జరిగిన scheduled offence ద్వారా వచ్చిన “Proceeds of Crime” గా పరిగణించి PMLA కింద attach చేయవచ్చా? ఈ ప్రశ్నకు సంబంధించి Andhra Pradesh High Court ఇచ్చిన Kumar Pappu Singh Vs Union of India తీర్పు మరోసారి property-law చర్చలోకి వచ్చింది.
అయితే ఇది 2026లో కొత్తగా వచ్చిన తీర్పు కాదు. Andhra Pradesh High Court ఈ judgmentను March 20, 2021న ఇచ్చింది. అసలు కేసు ఏంటి?
Kumar Pappu Singh కేసు IDBI Bankకు సంబంధించిన Kisan Credit Card (KCC) fish-farming loans వ్యవహారం నుంచి వచ్చింది.

High Court ఏం చెప్పింది?
Andhra Pradesh High Court PMLAలోని Section 2(1)(u) లో ఉన్న “proceeds of crime” definitionను పరిశీలించింది.
Court ముందు ఉన్న factsలో Table-I properties scheduled offence జరిగిన సమయానికి ముందే acquired అయినట్లు గుర్తించింది. ED వాటిని తర్వాత నేరం ద్వారా వచ్చిన proceeds of crime ఖర్చైపోయినందుకు equivalent-value propertiesగా పరిగణించడానికి ప్రయత్నించింది.
High Court ఆ reasoningను అంగీకరించలేదు.
నేరం జరిగిన తరువాత proceeds of crimeగా మారిన మొత్తానికి, అంతకుముందే కొనుగోలు చేసిన propertyని కేవలం equivalent value ఆధారంగా attach చేయడం సరైనది కాదని Court held చేసింది. Table-I propertiesకు సంబంధించిన provisional attachmentను set aside చేసింది.
Pre-Offence Property అంటే?
సింపుల్గా చెప్పాలంటే:
Scheduled offence జరగడానికి ముందే ఒక Property కొనుగోలు చేసి ఉంటే దాన్ని Pre-Offence Propertyగా చూడవచ్చు.

Property కొనుగోలుకు ఉపయోగించిన డబ్బు నిజానికి criminal activity నుంచి వచ్చినదని చూపించే evidence ఉంటే legal position వేరుగా ఉండవచ్చు.
అందుకే Property acquisition date మాత్రమే కాకుండా funds source మరియు criminal activityతో connection కూడా కీలకం.
